Closure and workforce reductions: Notable experience includes, among others, advising (a) a global pharmaceutical company on closure of its manufacturing plant in India employing a large workforce, in a phased manner by deploying a multitude of consensual workforce reduction mechanisms and schemes, (b) a leading German renewable energy company on termination of a senior managerial employee of its Indian subsidiary for breach of duty and misrepresentation, including on legal risks associated with the termination, statutory requirements, severance pay and other contractual obligations to the employee

General employment advisory and investigations: We regularly advise large multinationals across various sectors as well as prominent global non-profit organisations on day-to-day employment related issues including but not limited to employee hiring/ separation, employment policy matters, employee benefits, compliance matters as well as specific employment issues such as those pertaining to joint employment risk under Contract Labour Act, employee data protection matters, updating employee office protocols among others. We also regularly advice and assist clients in conducting internal investigations/ enquiries on employment issues. For instance, we recently advised a client in carrying out an internal investigation in connection with a whistle-blower complaint pertaining to potential misconduct by certain employees of the client, including a violation of the US FCPA and the Indian Prevention of Corruption Act.

Stock award programmes: Notable recent experience includes advising US based global private equity fund on global ESOP scheme covering a large employee base in India, advising multiple clients in the e-commerce space in setting up, restructuring and overhaul of ESOP plans to align with client’s commercial objectives and evolving industry practice.

Employment advisory in transactions: We have recently advised a number of private equity funds, listed companies and multinational corporations on employment law issues arising from their M&A transactions in India, including business transfers, asset transfers, demergers and internal business restructuring.

Employment Disputes: [indicative language: We have extensively advised and supported clients in relation to litigation with trade unions and regularly represent our clients before labour forums and courts. We have successfully defended labour disputes before Labour and Industrial Forums and High Courts under their writ jurisdiction. We have also advised various clients and have handled disputes/ litigations initiated by senior level executives challenging their termination/dismissals.
